Delhi Chief Minister Arvind Kejriwal will not appear
before the ED even today in the liquor policy case. The investigating agency
had sent him the fifth summons on January 31 and asked him to appear on
February 2. AAP said that ED's summons is illegal. PM Narendra Modi's goal is
to arrest Arvind Kejriwal and topple the Delhi government. We will not let this
happen.
ED had earlier sent summons to Delhi CM on January 17,
January 3, December 21 and November 2, but he did not appear. Kejriwal had said
on January 17 that BJP wants to arrest me, so that I cannot campaign in the Lok
Sabha elections. Former Delhi Deputy CM Manish Sisodia and AAP MP Sanjay Singh
are in jail in the liquor policy case.
AAP will protest outside BJP office, Kejriwal will also
join
Here, in Delhi, the Aam Aadmi Party (AAP) is going to
protest outside the BJP office today against the irregularities in the
Chandigarh Mayor elections. Kejriwal and Punjab CM Bhagwant Mann will also
participate in this. Regarding this, a large number of security forces have
been deployed in many areas outside the AAP-BJP office including DDU Marg,
Vishnu Digambar Marg.
BJP has also announced a protest outside the AAP
headquarters. However, the police has not given permission to AAP and BJP to
protest. Actually, BJP had won the mayor election held on January 30. AAP says
that BJP has registered victory by cheating.
Accused of stopping AAP workers from coming to Delhi
Before the demonstration, Kejriwal and AAP leaders
accused the protesters of stopping them from coming to Delhi. Kejriwal wrote on
the social media platform - AAP MLAs, councilors and workers are being detained
in Delhi who were coming to the party office. What is this happening?
Delhi government minister Atishi wrote in his post - A
police vehicle is parked outside the office of Kondli MLA Kuldeep Kumar, so
that he can be prevented from joining the protest. Is it now a crime to
participate in peaceful protests?
ED has the right to arrest, Kejriwal can go to court
According to law experts, ED can issue a bailable warrant
against CM Kejriwal for his repeated non-appearance. Even after this, if he
does not appear, a non-bailable warrant can be issued under Section 45.
Experts of Prevention of Money Laundering Act (PMLA) say
that if a concrete reason is given for not appearing then ED can give time.
Then issues notice again. Under the PMLA Act, repeated disobedience of the
notice can lead to arrest.
If CM Kejriwal does not appear further then the
investigating officer can go to his residence and interrogate him. If there is
solid evidence or satisfactory answers to the questions are not received, they
can be arrested.
At the same time, after the warrant is issued, Kejriwal
can go to the court and promise to cooperate in the investigation in the
presence of his lawyer. On this, the court can direct the ED not to arrest him.
