Supreme Court announces to formulate law on quashing of High Court orders

The Supreme Court on Friday said it will formulate a law on the issue of quashing orders passed by high courts in open courts. The apex court has come across a case in which the Madras High Court had dismissed a money laundering case against a former IPS officer and later modified its direction to re-hear the matter. A bench of Justices Abhay S Oka and Augustine George Masih stayed the proceedings in the money laundering case registered against former IPS officer M S Jaffer Sait in connection with the alleged illegal allotment of a Tamil Nadu Housing Board plot.
The apex court has fixed the hearing of the case on November 22. The apex court was hearing a plea filed by Sait, who argued that his case was re-heard within a few days of accepting his plea to quash the proceedings in the case. The Supreme Court bench had earlier sought a report from the Registrar General of the Madras High Court on the issue. On September 30, after examining the high court's report, the apex court had termed the high court's decision to re-hear the case as 'absolutely erroneous'. A high court bench of Justices S M Subramanian and V Sivagnanam had on August 21 quashed the proceedings against Sait on the ground that the corruption case registered by the Directorate of Vigilance and Anti-Corruption, which is the main offence for the ED case, has already been quashed by the high court. Later, the order was set aside and the case was re-heard and the verdict was reserved. According to Sait, a complaint was made in 2011 accusing him of illegal allotment of Tamil Nadu Housing Board plots in Thiruvanmiyur, Chennai. Based on the complaint, the DVAC registered an FIR under the Prevention of Corruption Act. On May 23, 2019, the high court quashed the FIR. Subsequently, on June 22, 2020, the ED filed an ECIR based on the case filed by the DVAC. However, the High Court quashed the ED case on the ground of quashing of the earlier corruption case by the Directorate of Vigilance and Anti-Corruption.
