सुप्रीम कोर्ट शुक्रवार को केंद्रीय जांच ब्यूरो (CBI) द्वारा बॉम्बे हाईकोर्ट के उस फैसले के खिलाफ दायर याचिका पर सुनवाई करेगा, जिसमें आईसीआईसीआई बैंक की पूर्व प्रमुख चंदा कोचर को कथित वीडियोकॉन ऋण धोखाधड़ी मामले में जमानत पर रिहा किया गया था। जस्टिस संजीव खन्ना और संजय कुमार की पीठ सीबीआई की विशेष अनुमति याचिका पर सुनवाई करेगी। इस साल फरवरी की शुरुआत में, शीर्ष अदालत ने कोचर को अंतरिम जमानत देने के बॉम्बे हाईकोर्ट के जनवरी 2023 के फैसले के खिलाफ केंद्रीय जांच एजेंसी की याचिका का निपटारा कर दिया था। हालांकि, इसने सीबीआई को कोचर दंपति को दी गई अंतरिम जमानत की पुष्टि करने वाले हाईकोर्ट के अंतिम फैसले के खिलाफ नई अपील दायर करने की स्वतंत्रता दी थी।
The Supreme Court will hear on Friday a plea filed by the Central Bureau of Investigation (CBI) against the Bombay High Court's decision that released former ICICI Bank chief Chanda Kochhar on bail in the alleged Videocon loan fraud case. A bench of Justices Sanjiv Khanna and Sanjay Kumar will hear the CBI's special leave petition. Earlier in February this year, the apex court had disposed of the central probe agency's plea against the Bombay High Court's January 2023 decision granting interim bail to Kochhar. It, however, gave the CBI liberty to file a fresh appeal against the final order of the high court confirming the interim bail granted to the Kochhar couple.
In the judgment delivered on February 6, Bombay High Court Justices Anuja Prabhudesai and Nitin R. "The arrest made on 23.12.2022 was not based on any additional material found during the investigation but on the same material which was within the knowledge of the investigating officer at the time of issuance of notice under Section 41A. Such routine arrest without due consideration and without due regard to law is an abuse of power and does not satisfy the requirement of Section 41A(3) CrPC," the high court said, adding that the CBI "failed to demonstrate the existence of circumstances or supporting material on the basis of which the decision to arrest was taken." Chanda Kochhar and her businessman husband Deepak Kochhar are accused of taking bribes during their tenure in exchange for loans given to the Videocon Group.
